Terms of Service

These Terms of Service ("Terms") govern your access to the mangotuesday.com website and your purchase and use of the audio software ("Plugins") offered by Lake Missoula Ventures, LLC ("Mango Tuesday", "we", "us"). By buying or using a Plugin, you agree to these Terms. If you do not agree, do not purchase or use the Plugins.

1. The collective & what we sell

Mango Tuesday is a music-artist collective that designs and sells downloadable audio plugins (instruments and effects) for use in digital audio workstations. The Plugins are digital goods, delivered electronically. We do not sell physical media.

2. Your licence

When you buy a Plugin, you are not buying the software itself; you are buying a licence to use it. Subject to these Terms and your payment, we grant you a worldwide, non-exclusive, non-transferable, perpetual licence to:

  • install and use the Plugin on any number of computers that you personally own and use. The licence belongs to you as a person, not to a machine, so there is no activation count to manage;
  • use it to create audio and music for any purpose, including commercial releases. Anything you make with it is entirely yours, and we claim no rights in your output.

You agree that you will not:

  • resell, rent, lend, sub-license, or redistribute the Plugin or your licence file;
  • share your licence file publicly or use it to enable use by people who have not bought a licence;
  • copy, modify, decompile, disassemble, or reverse-engineer the Plugin, except to the limited extent that applicable law expressly permits despite this restriction;
  • remove or alter any copyright, trademark, or licensing notices.

How licensing works

Your licence is delivered as a personalised licence file that carries your name and email address and is verified by the Plugin entirely on your own computer. There is no hardware dongle, no activation server, and no online check-in: a Plugin never contacts the internet to decide whether it runs, and an installed, licensed Plugin will keep working even if our servers, or we, are gone.

Because the licence file identifies you, keep it private, as you would a receipt. If a licence file is shared or leaked publicly, we may decline to honour it in future downloads and updates of the software; we will never remotely disable or degrade software you have already installed. If your licence file leaks through no fault of your own, write to us and we will reissue it.

The free trial

Every paid Plugin can be tried free for 14 days. You request a trial on the product page with your email address, and we email you a personalised trial licence file. It works exactly like a full licence, verified on your own computer with no online check-in, except that it carries an expiry date; when the trial ends, the Plugin returns to its unlicensed state until you add a purchased licence, and nothing you made with it is touched. One trial per Plugin per person: asking again re-sends your original trial licence rather than starting a new clock. Trials are free and require no payment details.

All intellectual property in the Plugins, the website, and the Mango Tuesday brand remains ours or our licensors'. We may offer separate terms for site licences or educational use; where we do, those terms control for that purchase.

3. Prices & payment

Prices are shown on the relevant product page and may change at any time, though a change never affects a purchase you have already completed. Our checkout is operated by Paddle, which acts as the merchant of record for your order: Paddle handles payment, calculates and remits any sales tax or VAT, and appears as the seller on your receipt and card statement. By paying, you also agree to Paddle's buyer terms. We do not receive or store your full card details. Prices may be shown and charged in your local currency where we offer it, for example in euros or pounds sterling. Where local law requires it, for example for consumers in the UK and EU, the prices shown include VAT; elsewhere, for example the United States, any applicable tax is added and shown at checkout before you pay. You remain responsible only for charges your own bank or card issuer may add, such as currency-conversion fees.

4. Delivery

Delivery is electronic. After your payment is confirmed, we will make the installer and your licence file available to you, normally by email and/or an on-screen download link, typically within a few minutes. It is your responsibility to give a valid email address and to keep your installer and licence file somewhere safe. If you lose either, write to us from the email address you purchased with and we will resend them.

5. Refunds

Because your purchase is completed through Paddle as merchant of record, refunds are handled by Paddle under our Refund Policy and Paddle's own refund policy. In short: the Plugins are downloadable digital goods, and transactions are non-refundable except where the law gives you a refund or cancellation right (for example the 14-day withdrawal right for EU and UK consumers, which ends once download begins with your consent), where a product is defective or not delivered, or as Paddle's refund policy otherwise provides. Statutory rights always apply, and nothing in these Terms removes them. To ask about a refund, use the link in your Paddle receipt or write to ryan@mangotuesday.com.

6. Updates & support

We provide maintenance and bug-fix updates within the version you purchased at no extra cost, for as long as we reasonably support that version. Updates are delivered as new downloads through your purchase email or download link; installed software is never modified remotely. A future major version may be a separate paid product. We offer support by email at ryan@mangotuesday.com and will do our best to help, but we cannot guarantee that a Plugin will be compatible with every future operating system, host, or hardware change.

7. The forum

Our forum is open to anyone who signs in with an email address. What you post stays yours; by posting you give us a non-exclusive licence to display it there, which is what a public forum is. Keep it lawful and civil: no spam, no harassment, no posting other people's private information or copyrighted work you have no right to share. We may edit for formatting, move, lock, or remove posts, and restrict accounts, at our reasonable discretion, to keep the room useful. If you want your posts or your account removed, email us and we will do it.

8. System requirements & your responsibility

Each product page lists the systems and host formats (VST3, AU, Standalone) the Plugin supports. Please check them before buying. You are responsible for having a compatible system and for backing up your work; audio software can behave unexpectedly, so never run an unfamiliar Plugin for the first time in a critical session without saving first.

9. Warranty disclaimer

The Plugins and website are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law. We do not warrant that the Plugins will be error-free or uninterrupted. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, Mango Tuesday will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, or audio work, arising from or related to your use of (or inability to use) the Plugins or website. Our total liability for any claim relating to a Plugin will not exceed the amount you actually paid for that Plugin. Nothing in these Terms limits liability that cannot be limited by law.

11. Changes to these Terms

We may update these Terms from time to time. The version in force when you make a purchase governs that purchase. We will post the current version here with its effective date, and material changes take effect when posted.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-laws rules, and the courts of that jurisdiction will have exclusive jurisdiction over any dispute, except where mandatory law in your country of residence gives you the right to bring proceedings, or requires a different governing law, that cannot be overridden by agreement.
